BOOKING TERMS & CONDITIONS

Triumph Sports Travel, LLC (“Triumph Sports Travel”, “TST”, or the “Company”) is a group tour operator which operates its group tours and travel packages under these Booking Terms & Conditions. By registering and paying your Deposit as described herein, you confirm that you have read, understood, and agree to these terms, which constitute a legally binding obligation.

Please review these terms carefully before making any deposit or payment. The Booking Terms & Conditions are supplemented by additional terms specific to your group tour contained in the Booking Order (the “Order Terms”). In case of a conflict, the Order Terms will apply.

These terms represent the entire agreement between you and TST regarding any bookings or transactions. By submitting a Booking Order, you accept all terms outlined here, which, along with your Booking Order, form your Agreement with us.

Review the following sections carefully before placing a Booking Order: Section 5 (Cancellation); Section 9 (Assumption of Risk / Safety / Release Of Claims); Section 13: (Liability Disclaimer and Limitations); and Section 18 (Acknowledgement of Mediation).  If you do not agree with these terms, do not submit a Booking Order.

1. RESERVATIONS AND BOOKING

1. Included in your trip: Only items specifically listed on the trip description on the TST website (www.triumphsportstravel.com) will be provided to guests (the “Travel Package”).
2. Exclusions from Travel Packages: Items not listed in the “Trip Features” or Package Description section of the Travel Package are neither provided nor covered by this Agreement. Specifically, airfare and other travel costs to or from the destination are not included unless explicitly stated. Transit to the hotel is also not included unless specified in the package description.    
3. Entry to Marathon Events:  Guaranteed entry (i.e. a bib) to marathon events is only available with a Travel Package for only those races that offer guaranteed entry. Race entry-only options are not permitted. Whether or not guaranteed entry is available in a Travel Package is specific per race and not available with all Travel Packages.
4. Booking Order: To register for a Travel Package, complete the Booking Order and pay the non-refundable Deposit. Submission of a Booking Order does not guarantee a reservation, as TST may reject a Booking Order for reasons such as lack of available spaces. If rejected, any payments for the Travel Package made to TST, including the Deposit, will be fully refunded.
5. Pricing Changes: Unless stated otherwise in a Travel Package description, prices are quoted and transacted in U.S. dollars (USD) and include all taxes based on current market value and exchange rates. Prices are subject to change with or without notice before you submit your Deposit and until packages are sold out.
6. Itinerary Modifications: TST will make reasonable efforts to ensure your Travel Package runs smoothly as per the Travel Package description and itinerary on our website and your Booking Order. However, we reserve the right to modify the Travel Package as needed to maintain smooth operations. The itinerary is a representation of planned accommodations, transport, and activities but may be altered or substituted without prior notice due to on-the-ground circumstances or Supplier recommendations or constraints. We will strive to ensure any changes provide an equivalent or better experience, but we are not liable for any loss or damage resulting from these modifications.
7. Airfare: Airfare is not included as a standard part of any TST travel package, unless otherwise stated. You are responsible for booking your own air transit. TST can recommend flight selection criteria, if needed upon request. Please note that airport and security taxes apply when booking airfare, and additional taxes may be charged at some international or domestic airports upon arrival or departure.
8. Registration of All Travelers: Only registered guests staying in the TST hotel room block are included in our Travel Packages. If a registered guest allows a non-registered guest to stay or attend TST activities without prior written approval, the registered guest’s Travel Package will be forfeited immediately without refund, and access to future tours may be denied. This policy is strictly enforced with no exceptions.
9. Flexibility Booking: We offer the flexibility for travelers to book individually while opting for double, triple or quad occupancy rooming. We will assist in matching you with your preferred travel mates (send travel mate information to hello@triumphsportstravel.com); however, if any of your selected travel mates do not complete their booking or fail to pay by the payment deadline, your final pricing will be adjusted accordingly based on the number of confirmed occupants in the room. If no suitable match is available, you will be required to pay the package price based on the final room occupancy. By booking, you acknowledge and accept this policy.

2. PAYMENT

1. Deposits:  A non-refundable and non-transferable deposit is required at the time of booking, including any applicable race entry fees (collectively, the “Deposit”). The amount of the Deposit will be specified in the online Travel Package description on the TST website.  

1. Deposits must be paid within 48 hours of receiving the Booking Order. Booking confirmations without a Deposit within the 48-hour deadline will be automatically canceled.
2. The booking is not complete until we receive a signed Booking Order, acceptance of the Booking Terms and Conditions (and other trip conditions, if applicable), and the full Deposit payment. Note: TST’s online registration requires full payment of Deposit and any other items (as described in the Travel Package) at the time of booking.

2. Final Payments:  Final payments are due at least 120 days before the departure date stated in your Booking Order unless specified otherwise in the online Travel Package description (the “Final Payment Deadline”). Payments made after this date will incur late fees, as detailed in the “Late Fees” section below.
3. Late Fees / Change Fees:

1. Late Payment Fee: A $50 fee applies to any installment or final payment received after the respective deadline.
2. Payments not received within five (5) calendar days of the respective installment payment due date or Final Payment Deadline may result in cancellation of the booking at TST’s sole discretion.
3. Change Fee: For booking changes after the Final Payment Date, a $50 fee per person per change applies. For changes requested less than 30 days before the first day of the Travel Package, the fee is $75 per person per change. Additional charges from travel or event suppliers which may result from changes to your Booking Order are your responsibility; you agree to reimburse TST for any such charges incurred by TST on your behalf. We will use our best efforts to accommodate the requested changes, however TST cannot guarantee such changes once the initial booking is confirmed.

3. ACCEPTED PAYMENT METHODS

1. TST accepts most major credit cards, and electronic bank transfers.
2. If paying in full, you will receive an invoice with a zero balance. If paying a Deposit, you will receive an invoice with additional payment instructions.
3. It is your responsibility to manage manual payments or enroll in auto-payments to meet deadlines and avoid late fees or cancellation.  Package installment and final payments not received by TST by the deadline are subject to late fees or cancellation at TST’s sole discretion.

4. DISCLAIMERS; BOOKING VERIFICATIONS

1. TST reserves the right to refuse a Booking Order application. If refused, the full registration fee, including the non-refundable Deposit, will be refunded.
2. Events are sold on a first come, first served basis unless specified otherwise (such as on a loyalty basis) in marketing materials for the event.  Note that some events are in very high demand and will sell out quickly; TST is not responsible if you fail to make a timely booking and miss an event Travel Package.
3. Event registration is subject to credit card approval and verification of billing information. Incorrect billing or credit card details may delay processing. We will attempt to contact you if there are issues; if we can't reach you, TST may cancel your order. If you don't receive a confirmation email or encounter errors after payment, it is your responsibility to confirm your Booking Order by contacting us. TST is not liable for any losses if you assume an order was not placed due to lack of confirmation.

5. CANCELLATION POLICY

Before completing a Booking Order, carefully review your purchase. If you need to cancel your completed Booking Order, your cancellation is subject to the following terms and conditions:

3. Your payments (including race entry, if applicable) are always non-refundable, regardless of when we receive your cancellation.

6. Payment Disputes: By submitting the Booking Order, you acknowledge that you have read and understand the cancellation provisions in this Section 5. Should you try to dispute these penalties with TST, your payment provider, or our payment processor, we may in our sole discretion refuse to honor any pending and future Trips for you or any guests associated with your Booking Order.
7. Effects of Cancellation: Regardless of your reason for canceling, or if we cancel your Trip, and regardless of when your Booking Order is, you will forfeit all accommodations and activities booked or organized by TST, including but not limited to your race entry.
8. Cancellation Notice: If you elect to cancel your Booking Order for any reason, you must notify us in writing (email is acceptable) as soon as you decide to cancel. Verbal requests will not be honored.
9. Cancellation Penalties: Please note the following cancellation penalties. This Section shall apply to any Booking Order, regardless of your reason for (including by way of example, if the race for which you are registered is cancelled by the race organizers or you experience an injury during training for a race, or if we have to cancel your Booking Order for any reason outlined in this Agreement, including but not limited to your failure to make your full payment as specified in Section 2.2 above.

6. EVENT CANCELLATION

1. In the event that the race you are registered for is canceled for any reason, the cancellation policy set forth above will apply. Notwithstanding the foregoing, TST will refund any race entry and travel fees paid, if possible, but only if refunded to TST by the race organizers.
2. TST reserves the right to cancel the Travel Package for any reason at any time. If we cancel a Travel Package, our liability shall be limited to a full refund of your payments to us, and we will not be liable for any other costs or refunds of any kind for any loss, delay, inconvenience, incidental, consequential or other damages whatsoever in such circumstances.

7. FORCE MAJEURE

1. Actions in the Event of Force Majure: In the event of force majeure— including but not limited to an Act of God, pandemic, epidemic, quarantine, heat wave, tornadoes, earthquakes, storms, lightning, floods, labor strikes, trade disputes, border closures or restrictions, fire, transportation or other service interruption or breakdowns, government or political action, acts of war or terrorism, acts of omissions of a third party, for any reason that would affect the safety and security of tour participants, or any other cause whatsoever outside TST’s reasonable control —we may cancel or modify all or part of any tour, itinerary, or event at our discretion. TST will not be liable for any delays, non-performance, or expenses including but not limited to death, bodily injury, illness, damage, delay, or other losses incurred due to force majeure. No refunds will be provided for cancellations unless authorized by TST.
2. Losses Related to Force Majeure: TST will not be responsible for any losses or costs related to a force majeure event, including but not limited to airfare or entry fees. If a force majeure event affects your trip, Section 5 (Cancellation) will apply. Therefore, TST strongly recommends trip cancellation, baggage, health and accident insurance for all participants as further described below. Residents from outside the U.S. must check within your country for appropriate insurance coverage.

8. TRAVEL DOCUMENTS & TRAVEL INSURANCE

1. Travel Documents:  It is the guest’s responsibility to check visa and other entry requirements for their destination and ensure that their passport complies with passport requirements of the countries to be visited. For the latest passport, visa, and other information, consult the U.S. Department of State website or your county’s equivalent, the destination consulate or your country’s Embassy. You are responsible for securing all necessary travel documents, including vaccinations and visas. TST shall not be responsible or liable for any trip interruptions, cancellations, or costs incurred by your failure to comply with the requirements of your destination or re-entry to the U.S.
2. Travel Insurance: Personal travel or trip insurance is not included in any TST package. We strongly recommend purchasing comprehensive travel insurance to cover illness, injury (including training injuries), death, loss of baggage, delayed baggage, personal items, medical evacuation, trip cancellation, and activities. Contact a travel insurance company for coverage details. TST is not liable for any travel-related expenses or financial losses incurred.  Travel insurance is not mandatory to participate in a TST Travel Package but is highly recommended.  

9. ASSUMPTION OF RISK / SAFETY / RELEASE OF CLAIMS

1. Risks: Travel involves risks to health and safety, including personal injury, disease, and dangers from transportation, natural events, political unrest, and terrorism. You hereby accept these risks and acknowledge that running or other fitness events carry additional risks.  It is your responsibility to consult a physician to ensure adequate physical fitness for the Travel Package.
2. Safety: Certain items may not be brought onto the property of any tour hotel, restaurant, vehicle or other tour premises, including without limitation, illegal drugs, controlled substances, firearms, or knives. In our sole discretion, TST may refuse service or remove you from Travel Package activities if you bring any of these restricted items on a Travel Package or are deemed dangerous, engage in disruptive or illegal behavior, or fail to follow TST’s or local rules and threaten the safety, security, comfort, enjoyment, or well-being of other guests, suppliers or TST employees or representatives, including, but not limited to, behavior that is verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene.  We may cancel your participation in the Travel Package under these circumstances without refund and prohibit your attendance at future TST events.
3. Release of Claims: You hereby expressly assume all risks and dangers associated with your Travel Package itinerary. You release TST and its Representatives from all liability for risks associated with the Travel Package, including costs from removal or non-compliance. You hereby expressly waive, release, covenant not to sue and forever discharge and TST and our agents, employees, officers, and directors from any and all liability, actions, causes of actions, suits, claims and demands arising out of or in any way connected with your booking or any activities in which you participate.
4. Security of Personal Items: You understand and agree that you are responsible for your own personal belongings during the Travel Package and, to the maximum extent permitted by law, TST is not responsible for any personal item or property that is lost, damaged or stolen during the Travel Package.

10. SUPPLIERS / HOTEL CONTRACTS

1. Third Party Suppliers: 

1. TST acts only as an independent contractor to supply or arrange for the travel services named in your Booking Order or Travel Package itinerary or otherwise to procure services or goods from third parties including but not limited to airlines, hotels and other lodging providers, local hosts, guides, bus lines, car rental companies, driving services, restaurants and providers of entertainment (the “Suppliers”). The Company takes reasonable care in selecting competent, reliable, and qualified Suppliers based on information that is reasonably available to us. That said, we act only as an intermediary for these Suppliers and do not and cannot control the quality of their services.
2. You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed by Triumph Sports Travel, and are not our agents or employees. TST assumes no responsibility whatsoever (and will not be liable) for any personal injury, property damage or other loss, accident, delay, misrepresentation, disappointment, inconvenience or irregularity which may be occasioned by reason of any act or omission of any of the Suppliers. All activities, transportation, lodging, and other events provided by Suppliers as part of an itinerary are subject to the terms and conditions contained in the Supplier’s tickets, exchange orders or vouchers issued by them and/or their sub-suppliers, and TST is not a party to those terms nor is it liable for any breach of those terms by any Suppliers.  

2. Hotels: TST contracts with hotels for blocks of rooms including types of rooms (single beds such as king or queen beds; and multiple beds, such as two twin beds or two queens). We make note of your requested room type during your reservation booking. However, room availability is based on hotel inventory at time of check in. TST may need to adjust your room type to accommodate rooms available. If we must change your room type, we will provide a complimentary change, or refund the difference for a reduced room type.

11. INDEMNITY

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS TRIUMPH SPORTS TRAVEL, ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, AND REPRESENTATIVES FROM ANY CLAIMS, DAMAGES, LOSSES, AND EXPENSES (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING FROM YOUR USE OF THE TST WEBSITE, PARTICIPATION IN ANY ITINERARY ACTIVITIES OR TRAVEL PACKAGES, OR YOUR VIOLATION OR BREACH OF THIS AGREEMENT.

12. WARRANTY DISCLAIMER

1. Warranty by You: By submitting a Booking Order, you warrant that (a) you are at least 18 years of age and have the legal authority to create a binding legal obligation, (b) you accept and agree to all the terms of this Agreement, and (c) all information supplied by you for the purposes of booking your Travel Package is true, accurate, current, and complete to the best of your knowledge.
2. Warranty Disclaimer: ALL TRAVEL PACKAGES ARE PROVIDED "AS IS", WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND/OR NON-INFRINGEMENT. TST makes no warranty, either express or implied, regarding the suitability, safety, insurance or other aspects of any Suppliers or the goods or services they provide.

13. LIABILITY DISCLAIMER AND LIMITATIONS

1. Disclaimer of Liability: SUBJECT TO SECTION 13.3 BELOW, TST SHALL NOT BE LIABLE TO YOU FOR ANY LOSSES OR DAMAGES (A) FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE (EXCEPT TO THE EXTENT CAUSED BY TST’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT), (B) CAUSED BY OR RELATED TO ANY SUPPLIER OR THE ACTS OR OMISSIONS, ERRORS, OR NEGLIGENCE THEREOF. In no event shall TST or its Representatives, Employees, or Directors be liable to you for any special, consequential, indirect, incidental, punitive, or other damages arising out of or in any way connected to this Agreement, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if we have been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
2. Limitations on Liability:  In no event shall TST be liable to you for any claim for other than compensatory damages, including but not limited to any indirect, consequential, punitive, special, exemplary or incidental damages, however caused, and whether sought in contract, tort or under any other theory of liability, and regardless of whether TST has been advised of the possibility of such damages. Without limiting the foregoing, TST will not be responsible for (a) the use or the inability to use this website or TST’s services; (b) the cost of procurement of substitute goods or services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from this website; (c) your participation in any itinerary activity or race coordinated by TST; (d) personal injury (e) unauthorized access to or alteration of your transmissions or data; (f) statements or conduct of any third party on a TST travel event, (g) any other matter relating to this website or TST products or services. You agree that TST’s maximum liability to you, for any reason or cause whatsoever, shall not exceed the amount actually received by TST from you.
3. Exclusions: NOTHING IN THIS AGREEMENT SHALL BE CONSTRUED AS LIMITING OR EXCLUDING TST’S LIABILITY FOR TST’S FRAUD OR FRAUDULENT MISREPRESENTATION OR ANY OTHER MATTER FOR WHICH IT WOULD BE ILLEGAL OR UNLAWFUL TO EXCLUDE OR ATTEMPT TO EXCLUDE LIABILITY. YOUR STATUTORY RIGHTS AS A CONSUMER ARE NOT AFFECTED BY THESE TERMS OF PURCHASE.

14. IMAGE RIGHTS RELEASE / MARKETING CAMPAIGNS

1. Image Rights:  By entering into this Agreement, you grant TST unlimited, royalty-free, worldwide, and perpetual permission to use, reproduce, distribute, and broadcast any photographs, images, videos, recordings, or other depictions of your participation in itinerary events or related activities. This includes the use of your name, likeness, voice, and appearance for any legitimate purpose, without compensation to you. TST and its Representatives have full ownership and rights to use these materials in any medium for marketing or promotional purposes. You acknowledge that no compensation will be provided for such use.
2. Marketing Campaigns: You also consent to receive emails about your Travel Package and other TST travel or other offers, with the option to opt-out of additional communications by contacting TST directly.

15. PRIVACY

By entering into this Agreement and submitting a Booking Order with TST, you understand and agree that the collection, use and sharing of your personal data is subject to our Privacy Policy (www.triumphsportstravel.com/privacy).

16. AUTHORITY TO REGISTER AND/OR TO ACT AS AGENT

You represent and warrant to TST that you have full legal authority and capacity to complete the Booking Order form, including accepting these Booking Terms and Conditions, including full authority to make use of the credit or debit card to which fees related to the Travel Package and race registration will be charged.

17. GOVERNING LAW

This Agreement, and any dispute with respect thereto, shall be governed by and construed in accordance with the laws of the State of North Carolina (regardless of the laws that might otherwise govern under applicable North Carolina principles of conflicts of law).

18. ACKNOWLEDGMENT OF MEDIATION

1. YOU UNDERSTAND THAT THIS AGREEMENT CONTAINS AN AGREEMENT TO USE MEDIATION TO SETTLE ANY DISPUTE THAT ARISES OUT OF OR RELATES TO THIS AGREEMENT WHICH CANNOT BE SETTLED THROUGH NEGOTIATION. YOU UNDERSTAND THAT BY SUBMITTING YOUR BOOKING ORDER, YOU WILL NOT BE ABLE TO BRING A LAWSUIT CONCERNING ANY DISPUTE THAT MAY ARISE THAT IS GOVERNED BY AGREEMENT TO USE MEDIATION, AND THEREFORE YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY. INSTEAD, YOU HAVE AGREED TO SUBMIT ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS AGREEMENT TO AN IMPARTIAL MEDIATOR IN ACCORDANCE WITH THE MEDIATION PROCEDURES SET FORTH IN THIS AGREEMENT.
2. You individually and on behalf of all of your heirs, personal representatives, executors, successors and assigns agree that you will settle the dispute by binding mediation administered by the American Arbitration Association. The mediation shall take place in Charlotte, NC, and shall be facilitated by a neutral party appointed by the American Arbitration Association. The costs of such mediation shall be shared equally by the parties thereto.

19. SEVERABILITY; SUCCESSORS AND ASSIGNS

If any provision of this Agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the Agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision. This Agreement shall inure to the benefit of and be binding upon you and Triumph Sports Travel and their respective heirs, legal and personal representatives, successors, and assigns.

20. MODIFICATIONS

TST reserves the right to update and/or alter these terms and conditions at any time. Any changes to these terms and conditions will be available online at www.triumphsportstravel.com and shall be effective from the date of publishing. It is your responsibility to be familiar with these terms and conditions and to monitor our website for any changes or updates thereto.

21. WAIVERS 

Any waiver by TST of any of its rights under this Agreement must be in writing. A waiver on one occasion does not waive a right for future occasions, nor does it waive any of TST’s other rights.

22. ENTIRE AGREEMENT

This Agreement contains all the terms and conditions agreed by you and Triumph Sports Travel relating to its subject matter and supersedes any prior agreements, additional terms, understandings or arrangements between you and TST, whether oral or in writing. Both you and TST acknowledge and accept that, by agreeing to this Agreement, you and we have not relied upon any representation, undertaking or promise except those in this Agreement.
